Welcome to SauceBossHotSauce.com (the “Site”). These Terms & Conditions (the “Terms”) govern your access to and use of the Site, as well as purchases from Sauce Boss Hot Sauce Co. (the “Company,” “we,” “us,” or “our”). By accessing the Site or buying our products, you agree to these Terms.

Designed for use in Canada and compliant with general principles of Ontario law. These Terms do not replace your statutory consumer rights.

1) Eligibility & Accounts

• You must be the age of majority in your province/territory to purchase. Our products are not intended for children.
• When you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• We may refuse service, close accounts, or cancel orders at our discretion where legally permitted (e.g., suspected fraud or policy violations).

2) Orders, Pricing & Payment

• Order Acceptance. Your order is an offer to buy. We may accept, reject, or cancel any order after placement; if payment has been captured and we cancel, we will issue a full refund.
• Prices & Currency. Prices are in Canadian dollars (CAD) and may change without notice. We are not responsible for typographical or system errors; we may cancel orders affected by such errors with a full refund.
• Taxes. Applicable sales taxes (e.g., HST/GST/PST) are calculated at checkout based on your shipping address and current tax rules.
• Payment. We use third‑party processors to handle payments securely. By submitting payment information, you authorize the charge for the full order total, including taxes and shipping.
• Pre‑Orders/Backorders. Estimated dates are not guaranteed. You may cancel before shipment for a refund.

3) Shipping, Risk of Loss & Title

• We currently ship within Canada. Shipping options, costs, and delivery estimates are shown at checkout.
• Title and risk of loss transfer to you upon delivery to the carrier. Please file claims for items damaged in transit with the carrier; we’ll assist where possible.
• Refused or undeliverable packages may incur return shipping/handling fees.

4) Returns & Refunds

Our return policy is described on our Refunds & Returns page (which is incorporated into these Terms). Where a return is approved, refunds are issued to the original payment method. Shipping charges are non‑refundable unless the return is due to our error or applicable law requires otherwise.

5) Heat/Allergy & Safety Disclaimer

• Our products may contain or come into contact with capsaicin (hot peppers), as well as potential allergens (e.g., garlic, citrus). Read labels carefully.
• Use responsibly: start small, wash hands after handling, avoid contact with eyes and skin, keep away from children and pets.
• By purchasing and consuming our products, you acknowledge the inherent risks of spicy foods and agree that you are solely responsible for how you use them.
• Nothing on the Site constitutes medical or nutrition advice. Consult a qualified professional regarding dietary concerns.

6) Website Use & License

We grant you a limited, non‑exclusive, non‑transferable license to access and make personal, non‑commercial use of the Site. Any scraping, data‑mining, reverse engineering, or use of the Site for competitive analysis without our written consent is prohibited.

7) Reviews & User Content

• If you post reviews, photos, or other content (“User Content”), you represent you own or control the rights to that content and it is accurate, lawful, and non‑infringing.
• You grant the Company a worldwide, royalty‑free, perpetual license to use, reproduce, modify, publish, translate, distribute, and display your User Content in any media for marketing and operational purposes.
• We may remove or edit User Content for any reason where legally permitted.

8) Prohibited Conduct

• Violating laws or third‑party rights; uploading harmful code; interfering with site security; or attempting unauthorized access.
• Automated use (bots, scrapers) without permission; bulk purchasing intended to circumvent purchase limits.
• Resale without authorization, misrepresentation of affiliation, or misuse of our trademarks.

9) Intellectual Property

All content on the Site—including text, designs, logos, product names, graphics, photos, videos, and code—is owned by or licensed to the Company and protected by Canadian and international IP laws. No rights are granted except as expressly set out in these Terms. SAUCE BOSS and related marks are trademarks of the Company.

10) Promotions, Gift Cards & Bundles

• Promo codes are single‑use, non‑transferable, cannot be combined unless stated, and may have minimums or expirations.
• Gift cards are final sale, not reloadable or redeemable for cash (unless required by law). Treat them like cash—lost or stolen cards may not be replaced.
• Bundles/kits may be returnable only as a complete set unless otherwise specified.

12) Third‑Party Services & Links

We may link to third‑party websites or use third‑party apps (e.g., payment processors, analytics). We are not responsible for their content, policies, or practices. Your use of third‑party services is governed by their terms and privacy policies.

13) Privacy

14) Disclaimers

17) Governing Law; Disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict‑of‑laws principles. The parties submit to the exclusive jurisdiction of the courts located in Ontario, Canada, for any dispute not subject to consumer dispute resolution rights.

18) Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date reflects the latest changes. If changes materially affect your rights, we will provide reasonable notice by posting to the Site.

19) Miscellaneous

• Severability. If any provision is found unenforceable, the remaining provisions remain in effect.
• No Waiver. Failure to enforce a provision is not a waiver of our right to do so later.
• Assignment. You may not assign your rights; we may assign our rights as part of a merger, acquisition, or asset sale.
• Force Majeure. We are not liable for delays or failures due to events beyond our reasonable control (e.g., natural disasters, strikes, carrier delays).
• Entire Agreement. These Terms, along with policies linked herein, constitute the entire agreement between you and the Company regarding the Site and purchases.
